Bankruptcy Attorney in Martinez, CA: Judgments and Liens

By The Somal Law Firm · Pleasanton, CA · 5 min read

A bankruptcy discharge ends your personal liability on most debts, but it does not automatically erase a lien already recorded against your home. For people with a Contra Costa County judgment, a bankruptcy attorney in Martinez, CA looks at both: whether the debt can be discharged, and whether the lien it created can be removed through a separate motion.

Martinez, the courthouse and the recorder's office

Martinez is the Contra Costa County seat. The Superior Court's main civil operations and the county Clerk-Recorder's office are based here, so a collection judgment against a county resident is frequently entered in Martinez, and a lien that follows it is recorded there as well.

Bankruptcy itself is a federal matter. Cases from Contra Costa County are filed in the Oakland Division of the U.S. Bankruptcy Court for the Northern District of California. The interplay between the state court judgment and the federal bankruptcy case is where most of the important decisions happen. If a judgment or lien is already on record, call (415) 754-0115 to schedule a free consultation, or share the details through our contact page.

How a judgment turns into a lien in Contra Costa County

A money judgment is a court's declaration that you owe a debt. On its own, it does not attach to property. Creditors take additional steps to turn it into a lien.

Abstract of judgment on real estate

When a creditor records an abstract of judgment with the county recorder, it creates a lien on real property the debtor owns in that county, and on real property acquired there later while the lien lasts. A lien recorded in Contra Costa County attaches to a home in Martinez, Pleasant Hill or Concord; a separate recording would be needed for property in another county. Our article on a judgment lien on a house in California explains how this affects refinancing and sales.

Liens on personal property

A creditor can also file a notice of judgment lien with the California Secretary of State, which can attach to certain business-related personal property such as equipment, inventory and accounts.

How long a judgment lasts

A California money judgment is generally enforceable for 10 years and can be renewed for additional 10-year periods. Our guide on how long a judgment lasts in California covers renewal and expiration.

What a bankruptcy discharge does and does not do to liens

Personal liability versus the lien

The discharge prevents the creditor from collecting the debt from you personally: no garnishment, no bank levy, no new lawsuit. But a lien is a claim against property, not against you. Under bankruptcy law, valid liens generally survive the discharge unless they are dealt with during the case.

Avoiding a judicial lien under section 522(f)

The Bankruptcy Code lets a filer ask the court to avoid, or cancel, a judicial lien to the extent it impairs an exemption the filer is entitled to claim. Judgment liens from collection lawsuits are judicial liens. In practice, this is often the most important tool for a homeowner with recorded judgments.

How impairment is measured

The court adds the judicial lien, all other liens on the property and the exemption amount the filer could claim. If that total exceeds the property's value, the lien impairs the exemption to the extent of the excess. When the excess is larger than the lien, the entire lien can be avoided. Property value is often the most contested number, so a supportable valuation matters.

Liens bankruptcy usually leaves alone

Section 522(f) applies to judicial liens, not to the voluntary mortgage or deed of trust you signed. Tax liens, and judicial liens securing domestic support obligations, are also outside its reach. A second mortgage that is completely underwater may be addressed in Chapter 13, but that is a different process.

Timing issues around a recent lien

If a creditor recorded an abstract of judgment within the 90 days before filing, the lien may also be challenged as a preferential transfer, depending on the circumstances. Separately, the timing of a filing relative to a scheduled sale under a judgment, or a pending order for a debtor's examination, can affect what the automatic stay is able to stop. These are dates to review before filing, not afterward.

It also helps to pull a current title report or a list of recorded documents for the property. Liens are sometimes recorded by creditors the homeowner has forgotten about, or by debt buyers under unfamiliar names, and every one of them needs to be identified before a motion is prepared.

How a bankruptcy attorney in Martinez, CA helps with judgment liens

Lien avoidance is not automatic. It requires identifying every recorded lien, choosing the exemption system that best protects the home, preparing a motion with a value supported by evidence, and serving the lienholder properly. After the order is entered, it is often recorded so a future title search reflects the change.

Frequently asked questions

Will a judgment lien stop me from selling my house?

In most cases, a recorded lien must be paid or released for a sale or refinance to close with clear title. Avoiding the lien in bankruptcy can remove that obstacle.

Can I avoid a lien after my case is closed?

Courts often permit a closed case to be reopened for a lien avoidance motion, but it is generally simpler to handle it while the case is open.

Does lien avoidance work in Chapter 7 and Chapter 13?

Yes. Section 522(f) is available in both chapters to the extent a judicial lien impairs a claimed exemption.

What if I don't own a home?

A real property lien does not affect someone without real estate, though the debt itself may still be pursued until it is discharged.

A recorded judgment can follow a property long after the debt is gone, unless it is addressed. Call (415) 754-0115 to schedule your free consultation with The Somal Law Firm, or reach us through the contact page to send copies of the judgment or abstract.
