Emergency Bankruptcy Filing in California: How It Works

By The Somal Law Firm · Pleasanton, CA · 5 min read

An emergency bankruptcy filing in California is a short-form petition filed quickly, often the day before a foreclosure sale or right after a bank levy or garnishment hits, to trigger the automatic stay. The full schedules follow within 14 days. It can buy critical time, but a rushed filing carries risks that are worth understanding first.

When a sale or levy is only days away, every hour counts: call (415) 754-0115 to schedule a free consultation, or use our contact page if you cannot call right now.

What counts as an emergency bankruptcy filing in California

There is no special emergency chapter in the Bankruptcy Code. The phrase describes an ordinary Chapter 7 or Chapter 13 case that is opened with the minimum documents the rules allow, because there is no time to prepare everything at once. Typical triggers include:

  • A trustee's sale of a home set for this week or tomorrow morning
  • A bank levy that has frozen a checking account
  • A wage garnishment about to take another paycheck
  • A car repossession that is imminent or just happened
  • A collection lawsuit about to reach judgment

In each situation the goal is the automatic stay, which takes effect the moment the petition is filed and generally halts collection activity against the filer and the filer's property. Our guide to the automatic stay in bankruptcy covers what it stops and what it does not.

The bare-bones petition: what is filed on day one

Even a skeleton case needs certain documents at the moment of filing. In general, they are:

  1. The voluntary petition, signed under penalty of perjury
  2. A list of creditors with their names and mailing addresses, often called the creditor matrix
  3. A statement disclosing your full Social Security number
  4. A statement that you completed credit counseling with an approved agency within the 180 days before filing (if the certificate itself is not yet in hand, it can generally follow within 14 days), or a certification of exigent circumstances explaining why the session could not be obtained in time

Credit counseling catches more last-minute filers than anything else. Approved agencies can often complete a session by phone or online the same day, but in most cases it must be finished before the petition is filed.

Which court hears East Bay cases

Residents of Alameda and Contra Costa Counties file in the U.S. Bankruptcy Court for the Northern District of California, which has a division in Oakland. Attorneys file electronically, so the petition can be on the docket within minutes of being finalized.

The 14-day clock after an emergency bankruptcy filing

Filing the petition starts a countdown. The remaining papers are generally due within 14 days, including:

  • Schedules of assets, debts, income and expenses
  • The statement of financial affairs
  • The means test form in Chapter 7, or the proposed repayment plan in Chapter 13
  • Pay stubs or other evidence of income received before filing

Extensions can be requested, but they are not automatic; a motion must be filed and granted. If the documents are not filed on time, the court can dismiss the case, and the protection it created disappears with it.

Stopping a foreclosure sale or levy in time

Foreclosure sales

The case must be filed before the trustee's sale is completed. Once the auction has happened, bankruptcy generally cannot undo it. After filing, the foreclosure trustee and the lender's attorney should be given the case number right away so the sale is postponed. Keeping the home over the long run usually depends on a Chapter 13 plan that cures the missed payments over time; Chapter 7 can delay a sale but does not cure a mortgage default. Bank levies and garnishments

The stay stops further collection, but money already taken is a separate question. Whether it can be recovered depends on timing and on California's exemption rules, which an attorney can apply to your facts.

The risks of filing in a rush

Speed has costs beyond paperwork. The petition and schedules are signed under penalty of perjury, and errors or omissions can put an exemption, or even the discharge, at risk.

Earlier cases can shrink the stay

If a prior bankruptcy case of yours was dismissed within the past year, the automatic stay in a new case may last only 30 days unless the court extends it on a motion filed and heard quickly. With two or more dismissed cases in that year, the stay may not arise at all without a court order. Some dismissals also bar a new filing for 180 days.

Why lenders watch for repeat filings

A series of skeleton cases filed only to postpone a sale can lead a court to grant a lender relief that applies to the property in future cases too. If an earlier case did not go well, read bankruptcy dismissed: now what before filing again.

Picking the wrong chapter

Choosing Chapter 7 when Chapter 13 was needed to save a house, or the reverse, can be difficult to fix once the case is open. Conversion is possible in some situations, but it is not a substitute for getting the decision right.

Frequently asked questions

How fast can an emergency bankruptcy be filed in California?

Because filing is electronic, a petition can be filed the same day once credit counseling is complete and the essential information has been gathered and checked. The practical limit is how quickly accurate facts and documents can be pulled together.

Can I file an emergency petition on my own?

Yes, individuals can file without a lawyer. The risks described above are heavier when filing alone under time pressure, and an attorney can review your situation before the petition goes in.

Does an emergency filing stop the sale automatically?

The stay arises on filing, but the people running the sale still need to know about it. Giving the trustee and lender's counsel the case number promptly is what prevents an auction from going forward by mistake.
